FIRST STEP – Brand availability research (previous search).
Before issuing your registration request, Idéiativa performs a wide search on INPI database so we can ensure your brand’s availability. Also, the brand adequacy is evaluated according to the Industrial Property Law in a way to avoid incidence on forbidden hypothesis.
SECOND STEP – Brand registration request issuance with INPI.
The request issuance with INPI is the formal act that starts the process of brand registration. Once the issuance is performed, Idéiativa prepares the necessary documentation, adjusts the logo or images according to INPI administrative rules and studies your activity in a way it is possible to ensure the widest protection to your brand through proper specification to your products and services.
THIRD STEP – Publishing brand registration issuance.
After issuance, the brand registration request is published in Revista da Propriedade Industrial (Industrial Property Magazine), official body for INPI publications. Then, with the publication, the period so third parties can contest the issuance starts.
FOURTH STEP – Registration approval publishing.
After publishing and with or without oppositions, INPI assesses the registration request verifying the brand availability and its compliance with the law. When it reaches the conclusion to Grant the registration, INPI publishes the request approval in Revista da Propriedade Industrial. As of such moment, the period to collect the federal fee that corresponds to the validity of the registration for the first 10 years and the issuance of the registration certificate starts.
FIFTH STEP – Registration Grant.
Once the due fees are collected for the first ten years of validity and for the issuance of the certificate, INPI grants the brand registration, publishing it in the Revista da Propriedade Industrial.
SIXTH STEP – Delivery of brand registration certificate.
The last step of the process occurs with the effective issuance and delivery of the brand registration certificate.
