What is industrial design?

OTo obtain industrial design registration with INPI is the necessary action to be taken in order to protect the external form of an object. Only through the industrial design registration the owner can obtain the exclusive rights nationwide, being able to prevent the use of the creation by third parties.

The validity of the industrial design is of ten (10) years, being able to be extended for three periods of five (05) years until it reaches the maximum of twenty-five (25) years of validity.

Idéiativa Propriedade Intelectual performs works related to the protection and maintenance of industrial designs, such as:

- previous studies of exploitation freedom and registrability;

- creation, issuance and follow-up of industrial design requests;

- collection of maintenance fees for registration with INPI;

- replies and demand opposition, subsidies and administrative procedures for nullity;

- delivery of registration certificate;

- surveillance and conflict of competitive registration;

- presentation of opposition and administrative procedures for nullity against competitive registration;

- legal action in issues pertaining to industrial designs.
